Terms of Service

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the service. By using the service, you represent that you meet this requirement and have the authority to enter into these Terms.

swagga.ai provides AI-powered tools for creating images, videos, and related creative content. Features may include text-to-image, text-to-video, motion control, chat assistance, and automated video workflows. We offer subscription plans and credit-based usage. Features, models, and pricing may change over time.

When you subscribe or buy credits, you are purchasing consumable credits that grant access to swagga.ai's AI generation services. You are not purchasing a fixed quantity of finished outputs, any specific result, or a guaranteed number of generations or amount of output per dollar.

The number of generations you can run depends on which models, features, and settings you choose, each of which consumes a different number of credits. The credit cost of an action is shown in the product before you run it.

Using credits to run a generation constitutes acceptance and use of the product. Once credits have been used, the digital product has been delivered to and consumed by you. Your subjective assessment of whether the credits represented good value for the price is not a defect in the service and is not grounds for a refund or chargeback.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at the contact email below if you suspect unauthorized access.

You must provide accurate account information and keep it up to date.

Paid plans and credit purchases are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.

Subscription fees are billed in advance according to the plan you select (monthly or annual). Credits are delivered to your account immediately upon payment and are consumed when you run generations; unused credits may expire or roll over according to your plan terms shown at purchase.

Prices are subject to change with notice. Tax may apply where required.

Refunds, cancellations, and payment disputes are governed by the sections below.

swagga.ai is a digital service. Subscription credits are delivered to your account immediately upon payment and are consumed as you generate. Because the service is delivered and used instantly, credits that have already been used are non-refundable.

If a generation fails due to a service error on our side, we refund the credits charged for that run. Provider moderation blocks, invalid inputs, or user cancellations are not eligible for credit refunds unless required by law.

Credits are consumed when a request is submitted for processing and are not refundable where a third-party provider moderates, filters, partially completes, or rejects the request, because provider costs are incurred regardless of the outcome.

Refunds are otherwise provided at our discretion. If you are unhappy with a charge or the service for any reason, please contact us at the support email below before disputing the charge, and we will work with you to resolve it.

You may cancel your subscription at any time through the account billing portal. Cancellation stops future renewals; it takes effect at the end of the current billing period and does not refund the current period or any credits already used.

You agree to contact us at the support email below to resolve any billing concern before initiating a chargeback or payment dispute with your bank or card issuer.

Initiating a chargeback or dispute for a subscription you authorized, where the service was delivered and used (for example, credits were granted to your account and generations were run), is a breach of these Terms and may be treated as fraudulent.

We may suspend or terminate accounts with open or unresolved chargebacks. To contest illegitimate disputes, we may submit account and usage records — including purchase timestamps, IP address, generation and run logs, and delivered outputs — to your card issuer and payment processor as evidence.

You remain responsible for amounts owed and for any dispute fees or costs we incur as a result of an illegitimate chargeback.

You retain ownership of prompts, uploads, and outputs you create, subject to third-party model provider terms and applicable law.

By using the service, you grant us a limited license to host, process, transmit, and display your content solely to operate and improve the service — including sending prompts and reference media to AI providers to fulfill your requests.

You represent that you have the rights necessary to upload and generate with your content, and that your content does not infringe any third party's intellectual property or privacy rights.

You agree not to:

• Use the service for any unlawful purpose or to generate illegal content.
• Harass, threaten, or harm others, or generate content that exploits or endangers minors.
• Infringe copyrights, trademarks, or other intellectual property rights.
• Attempt to circumvent usage limits, credit systems, referral protections, or security measures.
• Reverse engineer, scrape, or abuse the service or its APIs beyond normal use.
• Use the service to build a competing product using our outputs or infrastructure without permission.

AI-generated outputs may be inaccurate, incomplete, or unexpected. You are responsible for reviewing outputs before use, especially in commercial or public contexts.

AI outputs are inherently variable and subjective. What you purchase is access to the generation capability and the credits to use it, not any specific result. Dissatisfaction with the style, quality, or subjective acceptability of an output is not a service defect and is not grounds for a refund or chargeback.

Third-party AI providers may filter, moderate, partially complete, or refuse requests under their own content policies. Because we incur provider compute costs when a request is submitted, credits are consumed even when a provider moderates or blocks the request. This is expected behavior, not a service outage or defect, and does not entitle you to a credit refund.

We do not guarantee that any generation will succeed or meet your expectations.

The swagga.ai name, logo, interface, and underlying software are owned by Rainey LLC or its licensors. These Terms do not grant you any right to use our branding except as part of normal use of the service.

Third-party AI models and tools are subject to their respective provider terms.

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the service.

Upon termination, your right to use the service ends. Provisions that by their nature should survive (including disclaimers, limitations of liability, and dispute terms) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAINEY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the service will be resolved in the courts of the United States, unless otherwise required by applicable law.

We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use after changes constitutes acceptance of the revised Terms.
